These Terms and Conditions govern all Orders (defined below) and Purchases (defined below) made through SmokerShop.ca. Our Privacy Policy forms part of these Terms and Conditions. By placing an Order or making a Purchase, you agree to be bound by both our Terms and Conditions and Privacy Policy. If you do not agree, you may not use our website or purchase our products.
Definitions
In these Terms and Conditions:
“Confirmation Email” means the email sent to confirm acceptance of your Order.
“Contract” means the agreement between you and SmokerShop.ca for the sale of Goods.
“Goods” means Native cigarettes and other tobacco-related items offered for sale by us.
“Order” means your request to purchase Goods by submitting an order through our Website.
“Personal Information” means information you provide (such as billing/shipping details, email, etc.).
“Price” means the cost of Goods plus any applicable taxes and shipping fees.
“Purchase” means acceptance of an Order by us and confirmation via email.
“We”, “Us”, “Our” means SmokerShop.ca.
“Website” means www.smokershop.ca, or any updated domain we may use.

Your access to and use of our Website is subject to these Terms and Conditions and our Terms of Use.
General Conditions of Purchase
These Terms and Conditions apply to all Orders and Purchases.
SmokerShop.ca may update these Terms and Conditions at any time. The version available on our Website at the time of your Purchase will apply.
We recommend printing or saving a copy of these Terms and Conditions for your records.
Placing an Order
To place an Order on SmokerShop.ca:
Select the Goods you wish to purchase.
Choose the quantity and click “Add to Cart.”
Proceed to checkout, review your Order, and enter delivery and payment details.
Confirm your agreement to these Terms and Conditions and click “Place Order.”
Complete payment using the method provided (currently Interac e-Transfer).
Once payment is confirmed, we will send you an email acknowledging your Order. If Goods are out of stock, we will notify you with an estimated restock time and give you the option to wait or cancel. Your Contract with us is formed once we send a Confirmation Email.
Age of Consent
By placing an Order, you confirm you are of legal age to purchase tobacco products in your province (18 or 19+ depending on location).
Goods will not be sold or shipped to anyone under the legal age.
If we believe you are not legally eligible, we reserve the right to cancel your Order immediately.
Price & Payment
Prices listed on our Website are in Canadian Dollars (CAD).
Taxes and shipping costs are applied at checkout.
Payment must be made by Interac e-Transfer unless otherwise specified.
All transactions are processed securely through your financial institution.
Privacy
Our Privacy Policy forms part of these Terms and Conditions. It explains how we collect, store, and protect your Personal Information.
Our Rights
We reserve the right to:
Modify product pricing at any time.
Withdraw Goods from our Website without prior notice.
Refuse or cancel any Order at our sole discretion.
Delivery
Orders are generally processed within 2–3 business days (may take up to 7 days during busy periods).
Orders are shipped via Canada Post (Standard or Express).
Delivery times:
Standard Shipping (Free): 4–7 business days.
Express Shipping ($25 Flat Rate): 2–4 business days.
Tracking details will be emailed once your order has been shipped.
Shipping is available within Canada only. We do not ship to the U.S. or internationally.
Title & Risk
Ownership of Goods passes to you once:
The Goods are delivered, and
We receive full payment.
Risk of loss or damage transfers upon delivery.
Returns & Refunds
If your order is damaged or defective, notify us within 15 days of delivery.

Returns are only accepted for unused, unopened products in original packaging.
Upon inspection and approval, we will issue either:
A refund (to your original payment method), or
A store credit.
Shipping fees are non-refundable.
Refunds may take up to 3 business days to appear in your account.
Cancellation of Orders
Orders may be canceled if the package has not yet shipped.
Contact us immediately at info@smokershop.ca to request a cancellation.
Once shipped, Orders cannot be canceled.
Limitation of Liability
SmokerShop.ca is not responsible for indirect or consequential damages arising from use of our Website or Goods.
Our total liability shall not exceed the purchase price of the Goods in question.
Nothing in these Terms excludes liability for death or personal injury caused by our negligence.
Force Majeure
We are not responsible for delays or failures caused by circumstances beyond our control, including postal strikes, natural disasters, epidemics, or other events outside our reasonable control.
Severability
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will continue in full effect.
Your Legal Rights
These Terms do not affect your statutory rights under Canadian law, including your right to a refund for defective Goods.
